Terms of Service

These terms apply between you and Visbiz AS (company registration number 998 359 139, Håbamyrå 26, 4325 Sandnes, Norway), which provides the Nubilux service. By creating an account, you accept them.

What Nubilux is

Nubilux is a service that shows a family's shared overview — calendar, transport, weather, waste collection, lighting and more — on one or more screens in the home, managed from a web browser.

The service consists of a web application, an administration interface called Studio, and an app for the screen.

Account and household

  • You must be 16 to create an account yourself. If you are younger, a guardian must create it.
  • You are responsible for providing accurate information, and for keeping your password to yourself.
  • An account is personal. Do not share your login with others — invite them to the household instead.
  • A household is the unit that data belongs to. Members of a household see each other's shared content.
  • A household has one owner. The owner can invite and remove members, and has final say over the household's data. Ownership can be transferred, but a household can never be left without an owner.

Your responsibility for content about others

A wall-mounted screen shows data about more than you. When you enter information about a family member, a guest or a child, you are the one who entered it.

You must:

  • not enter information about others that they would object to,
  • tell the people concerned that the information is displayed on a screen in the home,
  • remove information about anyone who asks you to.

Use of the service

You must not:

  • attempt to access data belonging to other households,
  • circumvent quotas, limits or security mechanisms,
  • load the service in a way that affects other users,
  • use the service for anything unlawful, or to track or monitor anyone without their knowledge,
  • upload content you do not have the right to use.

If you breach this, we may close the account. If the breach is serious or ongoing, we do so without prior warning, and explain afterwards.

Modules

Nubilux consists of modules. Some are made by us, some may be made by other users.

  • Modules you create and keep to yourself are yours.
  • If you submit a module for publication, separate terms apply: Terms for submitting modules.
  • We may disable a module for all users at any time if it turns out to be unsafe, broken or in breach of the terms. It will then disappear from your screen without warning. That is intentional — a safeguard cannot wait for a notice.

External services

Nubilux retrieves data from third parties, such as Google, Entur, the Norwegian Meteorological Institute and Philips Hue. If you connect such a service, their terms apply in addition to ours for that part.

We cannot guarantee that an external source remains available, correct or free over time. If a source disappears, the module that uses it may stop working.

Subscription and payment

  • The service has a standard tier and a premium tier. What each tier includes is shown in the service.
  • Prices and quotas may change. Changes are announced a reasonable time in advance and take effect from the next billing period.
  • If you cancel, you keep access for the period you have paid for.
  • On downgrade, content exceeding the new tier's quotas may become unavailable, but it is not deleted without prior notice.

Payment processing has not been introduced yet. Until it is, the service is free of charge, and none of the points in this section are in use.

Availability

We do our best to keep the service available, but we do not promise any specific uptime. Maintenance may cause interruptions. The screen shows the last known information when it loses contact, and states when data is old.

Liability

Nubilux is an aid to keeping an overview, not a safety system or an alerting service.

  • Do not rely on Nubilux alone for anything with consequences if it is wrong — for example a departure time, a medical appointment or a deadline.
  • We are not liable for indirect losses, lost profits or lost data.
  • Our aggregate liability is limited to what you have paid for the service in the past twelve months.
  • Nothing here limits liability for intent, gross negligence or personal injury.

Termination and deletion

  • You can delete your account yourself, at any time, from "My profile".
  • Deletion is confirmed by an email link, and you have a 14-day grace period. Logging in during that period cancels the deletion.
  • If you are the sole owner of a household, you must either transfer ownership or delete the household along with the account.
  • We may terminate your account for material breach, or if we discontinue the service. If we discontinue it, we give reasonable notice and an opportunity to download your data.

Privacy

How we process personal data is described in the Privacy Policy.

Changes to these terms

We may change these terms. Material changes must be accepted the next time you log in. If you continue to use the service after a minor change, that counts as acceptance.

Governing law and venue

Norwegian law applies. Disputes are to be resolved amicably. Failing that, the venue is Norway.
